Bankruptcy is a legal proceeding carried out to free individuals or businesses from their debts. So, what happens when you file for bankruptcy? Let's see.

What Is Bankruptcy?

Bankruptcy is a legal action that is started when a person or company is unable to pay back their debts or other commitments. For those who are struggling to make ends meet, it offers a new beginning.

The bankruptcy process begins with a petition filed by the debtor, which is most common, or on behalf of creditors, which is less common. All of the debtor's assets have been measured and assessed, and some or all of the debt may be repaid with the help of the assets.

What Happens When Declaring Bankruptcy?

If you're struggling financially, bankruptcy gives you the opportunity to pay down a portion of your debts over time or have some of them eliminated entirely.

Either way, declaring bankruptcy grants what's called an automatic stay, which is essentially a block on your debt to keep creditors from trying to collect. They can't deduct money from your bank account, garnish your wages or go after any of your other as sets.

You'll then have time to work with the court and your creditors to determine the next steps.

In addition to this, bankruptcy can also have disadvantages that you should be aware of. Disadvantages of filing for bankruptcy protection include:

- Filing for bankruptcy stays on your credit profile for seven to 10 years

- Filing for bankruptcy can lead to higher interest rates when you are eventually able to obtain financing

- You will be required to take a court-approved credit counseling course

- You cannot use bankruptcy to discharge overwhelming debt again for at least four to eight years, depending on what type of bankruptcy you filed

Each individual or business debt load is unique and requires close scrutiny and careful debt reduction planning. Your lawyer can take a clear, objective, and comprehensive view of your financial situation and help you create a plan to reorganize, reduce, or eliminate your debt.
