bloXroute Labs, a prominent block producer on Ethereum known for its resistance to censorship, has made a notable pivot by declaring its intention to start censoring blocks authorized by the U.S. Office of Foreign Assets Control (OFAC) across all of its Maximum Extractable Value (MEV) relays to align with local legal requirements. This announcement was made on December 18 via a post on X (formerly Twitter), stating that bloXroute relays would reject block bids containing OFAC transactions effective immediately.
An "OFAC transaction," according to bloXroute Labs, pertains to any transaction interacting with an OFAC-approved wallet. This policy alteration will impact all bloXroute Labs relays, including its prominent "bloXroute Max Profit" relay, developed by the Australian blockchain firm Labrys, which has generated over 380,000 blocks and stands as the second-largest censorship-resistant MEV relay post the Ethereum merger on September 15, 2022.
Despite this shift, bloXroute Labs expressed its commitment to upholding Ethereum's decentralized and permissionless nature while adhering to legal regulations. They highlighted the importance of avoiding protocol-level censorship, advocating instead for the application-level enforcement of rules and regulations, similar to the governance of the Internet.
Concerns were raised regarding the global nature of Ethereum and the potential imposition of varying sanctions by different countries, making it challenging to create blocks compliant with diverse regulatory regimes. The dilemma deepens when considering the imposition of sanctions by nations like China or Russia and whether these should apply even if they target legitimate American businesses.
MEVWatch.info data revealed that around 36% of blocks are presently under review for containing OFAC-approved transactions, marking a decline from the peak of 78% observed on November 20. The ratio of blocks under scrutiny has typically fluctuated between 30-40% since March. MEV relays are utilized by validators to extract value from the blockchain, often at the expense of regular users. The introduction of the MEV-Boost relay aimed to mitigate the adverse effects on average users caused by MEV profits.
The transition of Ethereum to proof-of-stake on September 15, 2022, has amplified concerns about censorship. A month ago, OFAC initiated sanctions on specific wallet addresses linked to criminal activities and transactions from cryptocurrency mixers like Tornado Cash. This development has compelled numerous MEV relays worldwide to navigate between upholding Ethereum's neutral stance and complying with local legal standards.
While acknowledging the decision's potential impact on reducing its relays' win rates, bloXroute's representative, Feeney, indicated uncertainty about whether compliance was compelled but affirmed that the choice was made with substantial consideration, reflecting the delicate balance between regulatory adherence and Ethereum's ethos.
