Elon Musk, renowned for his ventures with SpaceX, Tesla, and X, is embroiled in a legal dispute with OpenAI and its CEO, Sam Altman. Musk alleges that OpenAI breached their non-profit agreement by collaborating with Microsoft, diverting from their core mission of advancing open source general artificial intelligence (AGI) for humanity's benefit.
The legal action, filed in San Francisco County Superior Court in California, outlines Musk's grievances, including breach of contract, breach of fiduciary duty, and unfair business practices. He demands OpenAI adhere to its open source principles and seeks an injunction to prevent the for-profit exploitation of AGI technology. Musk particularly criticizes ChatGPT-4, released in March 2023, for departing from OpenAI's original principles by operating as a closed model, which he believes will financially benefit Microsoft.
Initially established as a non-profit AI research lab in 2015, OpenAI transitioned to a commercial entity after launching a commercial arm in 2020, marking a departure from its non-profit roots. Critics, including Musk, argue that OpenAI's focus has shifted towards profit over its intended positive impact on humanity. With its flagship product, ChatGPT, driving rapid revenue growth, OpenAI reportedly amassed over $2 billion in annual revenue, making it one of the fastest-growing companies ever.
Musk has long viewed artificial intelligence as a significant existential threat, advocating for stringent government regulation and responsible AI research. He contends that broad knowledge is essential for understanding and addressing the challenges posed by AI technologies.
Additionally, Musk questions the technical expertise of OpenAI's current board, asserting their inadequacy for responsible AGI development. He points to Altman's removal and subsequent reinstatement in November 2023 as evidence of a profit-driven agenda, allegedly serving Microsoft's interests. Musk's concerns primarily revolve around the potential implications for public safety arising from the development of ChatGPT-4 and future AGI iterations.
