Ripple's chief legal officer has called for an investigation into the motives that led former SEC official William Hinman to deliver his now-infamous speech in 2018.
Stuart Alderoty Called for An Investigation as Part of a June 13 Twitter Thread after the Hinman Documents We Made Public. Hinman Delivered the Speech Despite Warnings F Rom Other PARTS of the Sec, The Documents Show. In A 2018 Speech, Hinman Asserted That Ether, Not a security because it becomes "sufficiently decentralized" before detailing what factors must be met to make that decision.
Alderoty argues that, according to the newly released filing, Hinman ignored warnings from other SEC officials that “his speech contained fictitious analysis with no legal basis,” and that the speech ultimately sent a confusing message to the cryptocurrency industry that w hat constitutes a security. Alderoty said unelected bureaucrats should just apply the law, not try to create new laws, adding: “Hinman's speech should never be invoked again in any serious discussion about whether tokens are securities.”
Ripple CEO Brad Garlinghouse added to Alderoty's criticism of regulators in a June 13 Twitter post, arguing that despite "so much resistance," the speech continues. The decision was "unconscionable". Pro-XRP lawyer and CryptoLaw founder John Deaton noted that he, too, believes an investigation is warranted, adding that the fact that Hinman referred to the speech as an “Ethereum speech” raises questions about the motivation for the speech. Deaton and Alderoty's comments on Hinman's motivations appear to refer to Hinman's alleged relation ship with the Enterprise Ethereum Alliance, an advocacy group that seeks to advance the use of ethereum's blockchain technology.
Before and after working with the SEC, Hinman worked at the law firm Simpson Thacher & Bartlett LLC, a member of the Ethereum Enterprise Alliance.
