U.S. Securities and Exchange Commission Chairman Gary Gensler recently addressed the topic of artificial intelligence (AI) in a speech prepared for Yale Law School, drawing inspiration from the 2013 film "Her." In the movie, Scarlett Johansson's voice represents an AI system that develops romantic feelings for Joaquin Phoenix's character. Gensler used this fictional scenario to underscore the potential implications of AI on financial stability, likening it to the reliance of numerous financial institutions on underlying models or data sources.
Gensler emphasized the importance of considering the risks and benefits of AI in the financial sector. He suggested that AI could have a significant role in post-mortem reporting on future financial crises, akin to its portrayal in the movie "Her." The SEC chairman urged for the implementation of appropriate safeguards or guardrails when deploying AI systems in finance, ensuring compliance with existing laws and regulations.
Drawing on examples from 1980s movies, Gensler illustrated his argument regarding the potential impact of AI on legal frameworks. He stressed the necessity for AI disclosures from SEC registrants to adhere to fundamental principles, such as providing investors with transparent and well-founded information about prospects. Gensler highlighted the continued relevance of traditional securities law principles even in the context of emerging technologies like AI.
While Gensler has previously scrutinized traditional financial institutions for their engagement with digital assets, he has also expressed openness to the SEC leveraging advanced AI models. He warned that without appropriate safeguards, the widespread adoption of AI in finance could potentially lead to a financial crisis. Gensler's term as SEC Chairman began in April 2021 and is expected to continue until 2026, during which he has overseen enforcement actions against various crypto companies, including Binance, Coinbase, and Kraken.
