The legal battle between the Securities and Exchange Commission (SEC), Terraform Labs, and co-founder Do Kwon has intensified as attorneys grapple over whistleblower information amid a securities lawsuit.
In a court incident detailed by Inner City Press on November 30, the SEC reiterated its assertion, based on sealed evidence from an undisclosed whistleblower, that Terra and Kwon engaged in fraudulent activities using the LUNA token. The transcript from the hearing highlighted the SEC's persistent claim against Terra, specifically regarding the purported misuse of the LUNA token in fraudulent actions.
However, attorneys representing Kwon and Terra reportedly accused the SEC of misrepresenting Kwon's statements and the context in which they were made. The legal team emphasized that the whistleblower, whose identity remains protected, did not disclose all relevant recordings. The courtroom discussion occurred during a session at the U.S. District Court for the Southern District of New York, where Judge Jed Rakoff declared that none of the documents filed under seal would retain confidentiality if the case proceeds to trial.
Meanwhile, on November 28, a judge approved certain confidential materials submitted by Jump Crypto, a company entangled in allegations related to the events leading to the separation of TerraUSD (UST) from the U.S. dollar.
Kwon's legal situation is further complicated as he faces potential extradition to either the United States or South Korea following his March arrest by Montenegrin authorities for allegedly using forged travel documents. In conjunction with the SEC's civil case, the U.S. Attorney's Office has filed eight criminal charges against Kwon related to fraudulent activities linked to Terraform Labs.
Pending Judge Rakoff's decision on the summary judgment motion, the SEC's case against Terra and Kwon is projected to commence in January 2024. Additionally, the sentencing of Sam Bankman-Fried, the former CEO of FTX who was convicted, is slated for March 2024. Furthermore, the trial of former Celsius CEO Alex Mashinsky is anticipated to take place in the same district in September 2024.
