Celebrities including reality TV star Kim Kardashian and boxing legend Floyd Mayweather have filed a motion with a California federal judge to dismiss a new lawsuit against EMAX.
A magistrate judge filed a similar charge against the defendants in December last year. Kim Kardashian, Floyd Mayweather, Paul Pierce, Jona Rechnitz, and Giovanni Perone asked the Central District Court of California to dismiss amended charges alleging that celebrities promoted EthereumMax (EMAX) to inflate its price.
Investors who lost money from their involvement with EthereumMax (EMAX) began a legal battle with celebrities last year. They maintain that the celebrity promoted the asset on social media to boost its valuation and then sold it for a profit.
The defendants claim the new case is indistinguishable from the one that a federal judge dismissed in late 2022. At the time, the magistrate said there was no guarantee that the investors suing had actually seen the promotion on the social platform.
Kardashian, who has more than 345 million followers on Instagram, reportedly received $250,000 to promote EMAX on her profile. She agreed to pay $1.26 million in October 2022 to settle the charges.
