Montenegro's Supreme Court has intervened to postpone the extradition of Do Kwon, co-founder of Terraform Labs, to South Korea, awaiting a decision on prosecutors' appeal. The Council of Montenegro's Supreme Court announced on March 22 that it would review a request concerning the legality of a lower court's ruling permitting Kwon's extradition. Prosecutors contend that the appellate court's dismissal of Kwon's legal team's appeal violated procedural norms and maintain that only the Supreme Court of Montenegro holds the authority to make such legal determinations.
Do Kwon, a South Korean national, appears inclined towards extradition to his home country rather than the United States, where he also faces criminal charges. He has been detained in Montenegro since March 2023 following his arrest for using forged travel documents. Competing extradition requests are under consideration, with potential consequences in both the United States and South Korea. In the U.S., Kwon faces eight felony charges linked to Terraform Labs' fraudulent activities, while in South Korea, he is accused of fraud and violating capital markets regulations. The outcome of the extradition dispute between the two nations remains uncertain.
Former Terraform Labs chief financial officer Han Chang-joon was arrested simultaneously with Kwon in Montenegro. However, Han was extradited to South Korea in February, signaling a divergence in the legal proceedings of the two individuals involved. South Korean authorities indicted several individuals, including co-founder Hyun-seong Shin, associated with Terraform Labs in April 2023.
